New Hampshire Pesticide Storage and Transportation Requirements

Structural pest control operators in New Hampshire move general-use and restricted-use products between shops, route trucks, and customer sites from Manchester multifamily corridors to Seacoast rentals and Lakes Region seasonal properties. NHDAMF’s Division of Pesticide Control administers commercial applicator and for-hire firm registration under RSA 430 and Pes rules. Storage and transport sit inside that framework - not only as federal-label or fire-code questions.

Chapter Pes 800 covers disposal and storage. Pes 802 details applicator storage rooms, setbacks, signage, fire-department notification, and spill cleanup. Pes 500 adds vehicle and equipment rules: label copies in the truck (Pes 502.02), service-container labeling (Pes 504.01), on-highway vehicle identification (Pes 504.02), and anti-siphon devices when drawing from surface waters (Pes 504.03).

This guide covers New Hampshire-specific expectations for pest control businesses. It does not replace federal labels, DOT hazmat rules, OSHA standards, NHDES Env-Hw requirements, or local fire and zoning ordinances. For Pes 804 bulk containment beyond typical structural-shop inventory, read official Pes text rather than inventing tank or pad specifications.

Confirm commercial for-hire firm registration under Pes 307 before designing fixed storage or lettering trucks. For-hire entities must register, name a principal supervisory license holder, meet Pes 302.03 insurance, and register before individual applicator certificates issue to employees (Pes 307.02(c)). Vehicle display under Pes 504.02 presupposes that Pes 307 registration exists.

Category inventory. Structural menus typically map to F1, F2, F3, F4, and F8 under Pes 302.01. Storing or transporting termiticides, fumigants, or microbial products without matching category credentials and a supervisory certificate holder at the managerial level (Pes 403.01) is a permissions failure before the first job is sold. At least one operational or supervisory registrant must be present on each crew during commercial applications (Pes 403.02).

Insurance linkage. For-hire ground-application registrants must show Pes 302.03 proof: at least $50,000 bodily injury per occurrence, $100,000 aggregate, and $50,000 property damage per occurrence, with chemical liability / products-completed operations when available. Name the Division as certificate holder with cancellation notice. Commercial applicators not for hire are exempt from financial-responsibility proof (Pes 302.03(e)) and from vehicle identification under Pes 504.02(b). Report firm location and ownership changes immediately under Pes 307.05 - moving a storage room is a registration event, not only a facilities project.

Pes 802.03 is the core New Hampshire rule for private and commercial applicator storage. Read current text on gc.nh.gov before building or converting a shop room.

Containers and separation. Store per label instructions. Keep legible content labeling (Pes 502.02 / Pes 504.01 cross-references). Use tightly sealed containment free from leakage, corrosion, breaks, or tears; unrepaired defective containers go to Pes 801.04 disposal. Separate pesticides and unrinsed containers from food, feed, seed, drugs, plants, and other materials.

Room construction. Secure storage so it is not readily accessible to children and the public. Floors must be smooth and spill-recoverable (sealed concrete or plastic examples); earthen floors are prohibited. Vent outdoors; keep dry and within label temperatures; local fire-suppression systems must comply with RSA 153:1, VI-a. Maintain lighting to read labels; keep areas clean; clean spills by end of day (Pes 802.03(v)). Floor drains without catch basins are prohibited; catch basins must meet Pes 802.02 (watertight floor feature, no below-floor piping, above-ground transfer within one hour).

Signage and fire notice. Signs must include “Warning,” “Danger,” or “Pesticides,” plus wording that pesticides are in storage, with lead words at least 1½ inches high. Display ambulance/fire or 911 numbers centrally. Notify the local fire department that pesticides are stored and of the storage room’s general location.

Setbacks. At least 400 feet from public wells; unless Pes 802.03(l) applies, at least 75 feet from private wells and surface-water high-water marks; down gradient wherever possible. Pre - April 13, 1993 facilities may qualify for the 75-foot exception only under Pes 802.03(l) containment criteria - confirm before relying on grandfathering.

Cabinets, winters, bulk. Cabinets, bins, and lockers count as storage rooms when they meet listed Pes 802.03 cross-references; over 15 cubic feet requires outdoor venting. Pes 802.03(i) allows limited unheated freezing-season storage for freeze-caution products with secondary containment and return to full compliance before and after freezing - build Merrimack Valley and North Country SOPs around that rule. Bulk storage must follow Pes 804; mini-bulk and dormant-oil exemptions appear in Pes 802.03(x) and (w) - confirm before treating totes as ordinary route stock.

Under Pes 801.01, no person may dispose of, discard, store, or transport pesticides or containers inconsistently with NHDES Env-Hw 500, EPA 40 CFR 261 - 262, Division rules, or the label. Unused or unwanted product stored prior to disposal must stay in a secure enclosure that prevents deterioration, unauthorized use, mishandling, loss, environmental contamination, and public-health risk (Pes 801.02).

Unusable pesticides follow Pes 801.03 return/disposal pathways. Triple-rinse containers per Pes 801.04; do not reuse containers except as the label allows (Pes 801.05). Empty containers not yet triple rinsed must be stored in the pesticide storage room pending disposal (Pes 802.03(p)). Treat canceled products, damaged concentrates, and unrinsed empties as a compliance system alongside active inventory.

Most New Hampshire structural firms treat service vehicles as mobile storage. Federal labels still govern temperature, segregation, and securement. New Hampshire adds Pes 504 equipment/vehicle rules and Pes 502 label-at-site rules.

Vehicle identification (Pes 504.02). On-highway vehicles used for commercial application business must display the business name and firm registration number (Pes 307.04) in contrasting, unobstructed letters at least two inches high. Commercial applicators not for hire are exempt (Pes 504.02(b)). Missing numbers are a compliance failure, not a branding preference.

Service containers and label copies. Pes 504.01 requires abbreviated labeling: product name; original concentrate signal word; common name and percentage of actives; firm name, address, and telephone; and dilute-or-concentrate notation. Pes 502.02 requires a complete copy of the original registered product labeling to accompany service containers and application equipment in the transporting vehicle - not SDS binders alone.

Anti-siphon and credentials. Equipment drawing water from surface waters of the state (Pes 101.36) needs an effective anti-siphon device (Pes 504.03) - especially relevant for F2 mosquito programs. Do not transport products for jobs your crew cannot legally perform under category credentials and Pes 403.02 presence rules. F4 fumigation inventory exceeds ordinary route-truck norms. Exterior shoreland, wetland, and public-water-supply watershed applications implicate Pes 502.03 - 502.05 and Pes 1001 and reinforce Pes 802.03 setbacks for storage near water.

Out-of-state fleets. No exam-waiver reciprocity was identified in reviewed Pes rules. Register the for-hire firm, insure with the Division as certificate holder, pass New Hampshire exams, and mark vehicles under Pes 504.02 before for-hire applications.

The Division conducts periodic inspections (Pes 403.03) and may issue cease-and-desist orders (Pes 404.01). Unlocked storage, earthen floors, missing fire-department notice, setback violations, unlabeled service containers, and unmarked trucks sit in the same enforcement picture as application misuse.

Under Pes 901.04, make records available annually for the period ending October 31, on or before December 1. Maintain daily application records at least two years (Pes 901.02). Products leaving shop or truck storage should reconcile to those records. Annual renewal (Pes 401.01) also expects insurance proof and use records/reports.

1. Confirm Pes 307 firm registration, Pes 403.01 supervisory coverage, and Pes 302.03 insurance before stocking concentrates or lettering trucks.
2. Match inventory to F1/F2/F3/F4/F8 credentials on staff.
3. Build Pes 802.03 storage: secure access, smooth non-earthen floors, outdoor venting when required, 1½-inch lead-word signs, emergency numbers, fire-department notice, and measured well/surface-water setbacks.
4. Treat cabinets over 15 cubic feet as vented storage rooms; plan winter freezing-exception SOPs under Pes 802.03(i).
5. Display business name and firm registration number in contrasting letters ≥2 inches (Pes 504.02); affix Pes 504.01 service-container labels; keep complete label copies in the vehicle (Pes 502.02).
6. Align disposal with Pes 801 and NHDES Env-Hw; store unrinsed empties in the pesticide storage room.
7. Reconcile withdrawals to Pes 901 records and the December 1 use-report cycle; read Pes 804 before installing bulk tanks - do not invent containment dimensions.
