New York Wood-Destroying Organism Licensing Requirements

Subterranean termites and other wood-destroying organisms threaten New York structures from Long Island split-levels to Hudson Valley colonials and Western New York doubles. NYSDEC Bureau of Pesticides Management does not authorize termite or post-construction WDO pesticide work through Category 7A - Structural & Rodent Control. Long Island and lower Hudson Valley generate enough termite demand that operators often treat 7C as a separate business line. Marketing termite protection or builder pretreats without Category 7C and business registration is a high-enforcement-risk mismatch. Federal label law always applies; New York adds ECL Article 33 and 6 NYCRR Part 325 on registration, staffing, insurance, annual reporting, and decals. NYC FDNY rules add company certificate and Certificate of Fitness requirements for covered fumigation - relevant when WDO programs implicate Category 7B.

NYSDEC assigns termite-control authority to Category 7C - Termite. Category 7A expressly does not include termiticides - that exclusion is the central compliance firewall for New York WDO licensing.

What fits Category 7C. Subterranean termite liquid barriers, bait systems, and related termite-control pesticide work labels and Part 325 assign to category 7C. Termite divisions use rodding tools, large-volume tanks, and bait monitors - not typical 7A route-spray gear.

Business layer. Category 7C certifies individual application authority; it does not replace Pesticide Business Registration for for-hire work. Categories 7C and 7D require a Certified Commercial Pesticide Applicator on staff per the business registration application. Technicians alone cannot satisfy applicator-required staffing.

7A boundary. Category 7A excludes post-construction wood-destroying organisms. WDO work beyond 7A scope needs the category DEC assigns - typically 7C for termite programs. Match pest identity, product tier, and official category scope before application.

Examination path. Applicators pass core plus category examination(s), unless qualifying for initial reciprocal certification. Exam fee is $100; first category certification is $450; each additional applicator category is $150. No official source reviewed publishes a numeric passing score - confirm on current DEC materials.

Many New York firms hold Category 7A for insect and rodent programs in NYC multifamily housing, Westchester suburbs, and Upstate routes. Category 7A does not include termiticides and excludes post-construction wood-destroying organisms. WDO work requires Category 7C - and Category 7B when fumigation is in scope - not 7A alone.

Common mistake. A 7A-certified firm advertises termite baiting because "we already have commercial certification." NYSDEC category scopes are not interchangeable; enforcement compares advertised services to categories on file.

Technician ceiling. Technicians hold one category only. A 7A technician cannot perform unsupervised termite work requiring 7C. When termite services are sold, business registration and applicator staffing must include 7C.

Supervision rules. Restricted-use supervision must match categories. A 7A-only applicator cannot supervise restricted termite applications requiring 7C. Multi-category applicators may hold 7A and 7C, paying $150 for each additional category beyond the first $450 fee.

Dual-category firms. Termite companies often maintain 7A alongside 7C for general pest routes. List every operating category on business registration with certified personnel before marketing or purchasing restricted termiticides.

New York splits wood-related pesticide authority beyond the 7A/7C firewall. Category 7D - Lumber & Wood Products covers lumber and wood-products pesticide work on NYSDEC's business registration application. Category 7C - Termite covers termite-control work. These are distinct credentials.

7D contexts. Utility pole treatment, millwork preservation, and lumber-yard commodity protection map to 7D when DEC category guidance assigns that scope. Structural termite authority under 7C does not automatically cover wood-product applications DEC assigns to 7D.

7C contexts. Subterranean termite liquid barriers, bait systems, and structural termite programs fall under 7C. Builder pretreats and residential warranty programs typically implicate 7C rather than 7D.

Staffing. Like 7C, Category 7D requires a Certified Commercial Pesticide Applicator on staff for business registration. Budget separate category exams ($100 each) and certification fees ($450 first category; $150 each additional) when offering both lines.

Location registration. Each location offering commercial pesticide services needs registration - $900 per three-year term, not prorated, not transferable. WDO services to homeowners, agents, and builders are commercial application for hire.

Applicator staffing. Categories 7A, 7B, 7C, 7D, 7F, and 7G require a Certified Commercial Pesticide Applicator on staff. Owner-operators often earn 7C first, then register. Technician-only plans cannot satisfy 7C or 7D staffing.

Timing. NYSDEC invoices after reviewing complete applications - do not prepay. Renewals are $900 for another three-year term. Expiration follows a region schedule (e.g., NYC Region 2: February 28; out-of-state: June 30). Apply at least 45 days before expiration.

Employees and decals. Applications must be made by business employees - not outside contractors. Display two Registered Pesticide Business decals on pesticide transport vehicles and ride-on equipment. Annual use reporting is due February 1 for the prior calendar year.

Category 7C covers termite-control work. Category 7B - Fumigation covers fumigation distinct from general structural control. WDO fumigation programs labels assign to fumigation require 7B, not 7C alone.

Operational firewall. Fumigation demands tarping, aeration monitoring, and emergency planning beyond 7C liquid and bait workflows. Many firms subcontract fumigation rather than certifying in-house.

NYC layer. FDNY requires company certificate and Certificate of Fitness for covered fumigation and insecticidal-fogging operations alongside NYSDEC 7B certification.

Customer communication. Distinguish non-fumigant termite treatments (7C) from fumigation (7B). Marketing fumigation without 7B applicator staffing matches the same category-mismatch error as marketing termiticides on 7A alone.

Category 7C and 7D certification follows the standard commercial applicator path: eligibility, training, core plus category exam, and three-year renewal.
