North Dakota Wildlife Control Licensing and Vertebrate Pest Credentials

Customers search “wildlife control,” but North Dakota splits pesticide authority across commercial applicator categories and leaves trapping, relocation, and many species-take questions to separate wildlife rules. The North Dakota Department of Agriculture (NDDA) enforces the North Dakota Pesticide Control Act (NDCC chapter 4.1-33). NDSU Extension, as board designee under N.D. Admin. Code 60-03-01-05.1, administers commercial certification training and examinations.

Under N.D. Admin. Code 60-03-01-05, Industrial, Institutional, and Structural Pest Control (Class 8 - NDSU: Home, Industrial and Institutional) covers pesticides in, on, or around dwellings, food-handling sites, institutions, industrial establishments, warehouses, grain elevators, and adjacent stored-product areas. Vertebrate (Class 15) covers pesticides for vertebrate pests such as rodents, certain predators, and bats not in or around structures, and does not authorize sodium cyanide or sodium fluoroacetate for predator control.

This guide is for owners expanding wildlife-adjacent menus in Fargo, Bismarck, Grand Forks, Minot, and Dickinson; rural operators asking whether Class 15 alone supports “wildlife” advertising; and property managers evaluating vendors. It does not invent Game and Fish permit fees, trap-tag schedules, or species take rules absent from the facts pack.

North Dakota does not issue a separate structural pest-control company license card. Authority rides on the individual’s Commercial Applicator Certificate in the correct category, with financial responsibility of at least $100,000 under NDCC 4.1-33-10. Pass core plus at least one category exam through NDSU Extension, complete the application, demonstrate financial responsibility, and pay NDSU training/education fees. A numeric pass percentage was not published on reviewed NDSU pages. Marketing “pest and wildlife” without matching Class 8 versus Class 15 - and without confirming wildlife trapping rules - creates enforcement risk.

Commercial applicator credentials authorize pesticide-based pest management within examined categories and federal label law. They do not automatically authorize live trapping, relocation, attic restoration, or regulated take under wildlife statutes.

Commercial Applicator Certificate. Required for purchasing or using restricted-use pesticides for monetary compensation (NDCC 4.1-33-07). NDDA’s Pesticide Regulatory Compliance Guide also requires commercial certification - or work under the direct supervision of a certified commercial applicator - when applying general-use pesticides for monetary compensation. A residential rodenticide route still needs commercial authority in the correct category even if every product is general-use.

Category matching. Class 8 does not authorize Class 15 outdoor vertebrate toxicant work outside structure scope, and Class 15 does not replace Class 8 for structure-invading rodents inside dwellings, warehouses, and grain elevators. Under N.D. Admin. Code 60-03-01-02, direct supervision of noncertified staff applying nonrestricted-use pesticides requires a certified applicator available if needed, able to physically arrive within thirty minutes, and in immediate phone or radio contact - unless the label requires a certified applicator to personally apply (NDCC 4.1-33-16).

No separate structural business license. Permission to apply for hire flows from personal category certification and financial responsibility. These credentials are not a universal animal damage control license and do not replace wildlife-agency trapping authority, tribal rules, local ordinances, or contractual insurance demands customers impose independently of NDDA.

Class 8 - Industrial, Institutional, and Structural Pest Control (NDSU: Home, Industrial and Institutional) - covers pesticides in, on, or around dwellings, institutions, warehouses, grain elevators, and adjacent stored-product areas (N.D. Admin. Code 60-03-01-05).

Within wildlife-adjacent scope. Structure-invading rats and mice with labeled rodenticides; other vertebrate pests when they infest structures within Class 8 site descriptions and label bounds.

Outside Class 8. Vertebrate pests not in or around structures map to Class 15 when pesticide applications fit that scope. Live trapping, hunting, and relocation are not pesticide-category permissions - confirm those on official wildlife materials.

Fumigation carve-out. Nonsoil Fumigation (Class 12) covers fumigating anything other than soil. Do not sell structural fumigation on Class 8 alone.

Class 15 - Vertebrate - covers pesticides for vertebrate pests such as rodents, certain predators, and bats not in or around structures. The scope does not authorize sodium cyanide or sodium fluoroacetate for predator control.

Within Class 15. Pesticide-based vertebrate control on pasture, rangeland, and similar non-structure contexts when labels and Class 15 authority align.

Structure invasions revert to Class 8. Rats and mice inside dwellings, institutions, warehouses, and grain elevators typically fall under Home, Industrial and Institutional - not Vertebrate alone.

Not a trapping license. Class 15 is a pesticide applicator certification category. Class 15 is not authority for exclusion, live capture, relocation, or regulated take. Pass the Vertebrate category examination (plus core if needed), maintain financial responsibility, and pay NDSU study-material charges. Certification renews every three years with expiration April 1 following the third anniversary.

Class 8 and Class 15 do not exhaust wildlife regulation. Trapping, hunting, species take, relocation, and related handling may fall under North Dakota wildlife-agency authority separate from the Pesticide Control Act.

Facts pack boundary. Facts verify the Class 8 versus Class 15 pesticide scopes and Class 15’s sodium cyanide / sodium fluoroacetate exclusions, but do not verify Game and Fish permit fees, nuisance wildlife permit names, trap requirements, relocation rules, or species-by-species take conditions. Confirm on official wildlife, NDDA, NDSU, and local materials before offering trapping.

Scenarios requiring dual research. Attic bat exclusions; raccoon and skunk trapping; coyote conflicts where customers expect lethal control; rural jobs mixing Class 15 pesticides with trapping; work on or near tribal lands.

When NDDA/NDSU credentials alone may suffice. Pure pesticide programs for structure-infesting vertebrates under Class 8, or non-structure vertebrate pests under Class 15 when labels and sites fit - without trapping or hunting wildlife agencies regulate.

Use this sequence before marketing combined pest and wildlife services.

1. Separate the service list. Pesticide work under NDSU categories versus trapping, relocation, or exclusion-only wildlife.
2. Map structure vs non-structure. Class 8 for pesticides in, on, or around structures; Class 15 for vertebrate pests not in or around structures.
3. Confirm fumigation separately. Nonsoil Fumigation (Class 12) is required for fumigating anything other than soil.
4. Honor Class 15 exclusions. Do not treat Class 15 as authority for sodium cyanide or sodium fluoroacetate predator products.
5. Research wildlife-agency rules before quoting trapping or regulated take.
6. Certify every for-hire applicator in the categories performed and maintain $100,000 financial responsibility.
