Arkansas Wood-Destroying Organism Licensing Requirements

Subterranean termites and other wood-destroying organisms threaten Arkansas structures from Delta crawl spaces to Northwest Arkansas new construction and southern pine-belt timber. Humidity, timber construction, and active real-estate corridors in Central and Northwest Arkansas keep termite volume steady. Marketing pretreats or Letters of Clearance without Class 1 credentials and matching financial responsibility is a high-enforcement-risk mismatch. Pest Control Program materials define Classification 1 as commercial structural and wood-destroying-organism work including soil pretreatments and letters of clearance. Class 1 license holders are subject to minimum treatment standards, contract and guarantee requirements, and monthly reporting under 2 CAR § 54.

What fits Class 1. Subterranean termite liquid and bait systems, soil pretreatments, post-construction remedial work, and letters of clearance tied to structural pest contracts - as rules and federal labels allow. Builder pretreats, lender expectations, and real-estate referrals typically implicate Class 1 when pesticides are applied for hire.

What Class 1 does not replace. EPA label compliance, License Holder firm authorization, bond and insurance filing, agent supervision, or Classification 3 fumigation authority. Product choice must match the federal label regardless of credential.

Class 1 operational rules. Verified fees under 2 CAR § 54-206: $5 per building under a structural pest contract, $10 late fee per building, $20 for the first five buildings for a new Class 1 licensee. Classification 1 on a Commercial Applicator license certifies the Licensed Operator to supervise and perform that work - it does not replace the License Holder credential for for-hire firms.

License Holder. Required for businesses offering pest control for compensation in Classifications 1 - 6; not transferable. The firm must employ and maintain at least one commercial applicator licensed for each classification offered, including Class 1 for WDO services. Class 1/2/3 License Holders must furnish bond and insurance copies before issuance under 2 CAR § 54-205.

Licensed Operator path. Pass EPA Basic Core at 70 percent (if not previously taken), then Class 1 at 75 percent, then apply with fees ($150 first classification, $100 each additional, $300 max; $100 per exam under 2 CAR § 54-206). The applicator must be a License Holder or employed by one; the license becomes invalid if that relationship ends. Owner-operators often earn Class 1 first, then apply for the License Holder license.

Agents and non-commercial limits. No more than 30 registered agents per commercial applicator; agents do not replace Class 1 operator authority. Non-Commercial Classification 7 certificates cannot issue Letters of Clearance, WDI reports, or termite contracts as commercial Class 1 work. Licenses expire June 30 annually; renew before July 1.

Classification 2 - Household Pest and Rodent Control - covers organisms infesting homes and buildings or immediate areas, other than wood-destroying insects, fungi, or organisms. WDO work is explicitly outside Class 2.

Common mistake. A Class 2 firm advertises termite baiting or clearance letters because "we already have a pest license." Arkansas classifications are not interchangeable - enforcement compares advertised services to License Holder and Licensed Operator classifications on file.

Financial track shift. Household-only Class 2 may use a $50,000 bond; any combination including termite requires $100,000 surety and $500,000 general liability under Ark. Code § 17-37-210. Firms may hold Class 1 and Class 2 simultaneously; each requires its own exam. A Class 2-only supervisor cannot oversee Class 1 WDO applications.

Classification 3 - General Fumigation - covers commercial general fumigation aligned to federal non-soil fumigation standards in Pest Control rules. Structural fumigation for hire requires Class 3 on the License Holder and a Class 3 Licensed Operator - not Class 1 alone.

Fumigation demands capabilities beyond Class 1 liquid and bait workflows; many firms subcontract rather than certifying in-house. Quotes should distinguish non-fumigant termite work (Class 1) from fumigation (Class 3). Non-Commercial Classification 8 certificates cover in-house fumigation only - they do not replace commercial Class 3 for hire.

Under Ark. Code § 17-37-210 and 2 CAR § 54-205, Class 1 License Holders must furnish bond and insurance before issuance or renewal. Termite or any combination including termite requires a $100,000 surety bond and general liability not less than $500,000 per occurrence or aggregate. Bond and insurance must remain in effect; failure voids the license until satisfactory coverage is filed; cancellation requires 30 days' notice to the Department.

Class 1 reporting. Monthly reporting fees under 2 CAR § 54-206: $5 per building under a structural pest contract, $10 late per building, $20 for the first five buildings for a new Class 1 licensee.
