Delaware Wood-Destroying Organism Licensing Requirements

Subterranean termites and other wood-destroying organisms threaten Delaware structures from humid New Castle County row homes to Sussex coastal cottages on termite-prone soils. The Delaware Department of Agriculture (DDA) Pesticide Section does not fold WDO authority into Subcategory 7A - General Pest Control. 3 DE Admin. Code 601 §7.7.2 defines Subcategory 7B as restricted pesticides other than fumigants in or around structures for prevention, suppression, or control of wood-destroying organisms. Treat WDO as a separate business line with distinct equipment, contracts, and customer expectations - not a route-card upsell.

What fits 7B. Subterranean termite liquid and bait treatments with restricted termiticides, other WDO programs using restricted products in structural contexts, and pretreat or corrective work when labels and Code scope align.

What 7B excludes. Fumigants route to 7C. General insect and rodent work remains 7A. Wood preservative treatments on poles or lumber route to 7D - a distinct subcategory from structural WDO work in existing buildings.

Exam requirement. Pass Core/general standards and 7B at 70 percent under §8.2. Apply at least one week before scheduled quarterly exam dates. Annual certification fee is $30.

Subcategory 7B certifies the individual technician; it does not replace the Pesticide Business License for for-hire operations under 3 Del. C. § 1206(a). WDO services sold to homeowners, real-estate agents, or builders are commercial pesticide activity. The license is not transferable.

The business must employ at least one certified commercial applicator at all times. For 7B business licensing, a designated certified applicator must document two years of supervised practical experience in the prior three years related to the license classification under § 1207(c)(1) and 601 §5.4. Business license fee is $50 annually or $100 biennial; late renewal carries a 20 percent penalty after January 1. Renew by December 31; applications by November 30 preserve validity.

Commercial Applicator (Not For Hire) supports in-house work on employer-owned property but does not authorize for-hire WDO. The business license expires upon expiration of liability insurance - maintain continuous coverage.

Subcategory 7A - General Pest Control - explicitly excludes wood-destroying pests and fumigants per §7.7.1. WDO restricted work requires 7B. A firm certified through 7A cannot legally advertise termite baiting or liquid barrier programs without 7B on file.

Technicians may hold 7A and 7B simultaneously; each subcategory requires its own exam at 70 percent. Supervisors must hold the subcategory for work supervised - a 7A-only supervisor cannot oversee 7B applications. 7B covers restricted pesticides other than fumigants for wood-destroying organisms. Fumigant applications in structures require Subcategory 7C - Fumigation Pest Control (non-agricultural) under §7.7.3 - not 7B alone. Subcategory 7D - Wood Preservatives under §7.7.4 covers pressure, non-pressure, or brush-on wood preservation on poles, lumber, or wood products - not 7B structural WDO treatment in existing buildings. Do not rely on 7B credentials for pole or millwork preservation, and do not assume 7B authority covers 7D product lines.

For business licenses listing 7A, 7B, or 7C, a designated certified applicator must document two years of supervised practical experience in the prior three years related to the license classification under § 1207(c)(1) and 601 §5.4. A newly certified 7B applicator cannot immediately serve as designee until experience is documented - plan hiring or ownership structure accordingly. Reciprocal certification under §12.0 waives the written exam when approved but does not waive experience or insurance requirements.

Business license applications require general liability with completed operations coverage of at least $300,000 bodily injury or death and $100,000 property damage per occurrence under §15.1.7 - or acceptable surety per § 1208.
